A Jewish lawyer was awarded a payout of over £26,000 in a religious discrimination case after he was sacked for not coming into work during Passover.
Philip Bialick, 43, is forbidden by his religion from working during the first two days of the Jewish holiday, and had booked the time off from his job at NNE Law in Manchester.
The firm is run by Ali Nazokkar, who was a friend of Mr Bialick and had employed him in January 2020 as a litigation executive.
But shortly after the pandemic hit, relations started to go downhill.

An employment tribunal heard that Mr Bialick, [https://www.cruisewhat.com/is-nutritional-yeast-kosher-for-passover/ www.cruisewhat.com] who lives in Bury, was unable to come into the office for the two weeks leading up to Passover, after developing symptoms of .
Philip Bialick, 43, is forbidden by his religion from working during the first two days of the Jewish holiday
He received a letter from his boss as his holiday was due to start, informing him he'd be fired if he didn't return to work the next day - as company policy didn't allow him to have more than two weeks off.

Despite responding to Mr Nazokkar via email during the first day of Passover begging to keep his job, Mr Bialick was fired from his position with immediate effect.
He has since been awarded compensation following a tribunal at Alexandra House in Manchester which concluded in December 2021.
It ruled he'd been discriminated on the grounds of his religion.
But Mr Bialick says he still hasn't received a penny of the £26,000 awarded by the court, and has had to instruct bailiffs to try and collect the money he is owed by the business.

NNE Law claim they have not paid out 'due to an application having been made for a stay of execution of the order as there are grounds for appeal which are currently being pursued'.
But Mr Bialick, speaking to the M.E.N., said: 'The owners are two brothers and were friends of mine for 12 years.
It's even more upsetting because they were friends.
'I've still not received the money. The bailiffs are involved now so it's ongoing.'
RELATED ARTICLES

Share

Mr Bialick said he had been enjoying his role at NNE Law but, shortly after the country was ordered into a national lockdown, he came down with a cough, bad chest, and cold-like symptoms.
'The office was based in the Regus building in Spinningfields and it was the tiniest room you'd ever seen and there were about four of us in there,' he said.
'Everywhere else was working from home.

We were the last firm in Manchester.. It was a ghost town, it was very scary.
'I got ill with coronavirus symptoms and I got signed off by the NHS and given an isolation note. My cousin had just died with covid so it was a very worrying time for me.
'I was given two separate isolation notes for a week each because my symptoms carried on. That ended just before the Jewish holiday which I had booked off.'
The tribunal heard Mr Bialick's leave for Passover had been granted from April 8 to 17.

The first two days are classed as 'High Holidays', meaning a Jewish person is not allowed to work, drive, or undertake activities of any sort.
But shortly before Passover was due to start, Mr Bialick received a letter from Mr Nazokkar stating if he did not return to work on April 9 he would be dismissed.
The firm stated they'd cancelled his holiday due to company policy which said that an employee couldn't be off for more than two weeks at a time - something Mr Bialick said he was never aware of.
Mr Nazokkar was ordered to pay a total of £26,479.86 to Mr Bialick
'I'd booked the Jewish holiday off near enough when I started.

It was agreed and the younger brother sat next to me and we spoke all the time,' he said.
'The day I received the letter was the first day of Passover. I had to break Jewish law by emailing them but I did it because I knew there was a lot at stake.
'I was absolutely gobsmacked when they told me I would have to come in on a Jewish holiday.
They were Muslim and we embraced our differences.'
Mr Bialick said following his dismissal his mental health deteriorated and he spiralled into debt. He has since been hired by a new law firm who are providing him with support.
'It was really bad.

I had no money at all. I went pretty much off the rails.. My mental health deteriorated massively. I didn't know where to turn,' he said.
'I was really upset and angry about how they treated me. I was desperate at the time as there was no work so I applied for an employment tribunal straight away.'
Following a three-day trial, a judge ruled Mr Bialick had succeeded in his complaint of indirect discrimination based on his religion or belief, under the Equality Act.

Mr Nazokkar was ordered to pay a total of £26,479.86 to Mr Bialick within 14 days of the hearing's conclusion - which was now over four months ago.
'Since then I've been chasing them and instructed bailiffs,' Mr Bialick said.
'I have lost a lot of money.
I'm getting to the point now where I'm desperate. I'm waiting for this money to come through and if it doesn't I'm in trouble.'
A spokesperson for NNE Law said: 'I would like to advise that the reason the judgement has not yet been satisfied is due to an application having been made for a stay of execution of the order as there are grounds for appeal which are currently being pursued.
'As this is a live matter, I am unable to go into detail about this.

NNE Law prides itself on it's diverse staff and having an inclusive approach. We are saddened that this situation has come about; especially with Mr Bialick having been a very close and personal friend of Mr Nazokkar for over a decade.'

adverts.addToArray({"pos":"inread_player"})Advertisement
By Rami Ayyub and Stephen Farrell

TEL AVIV, March 26 (Reuters) - Israel enters the Passover holiday this weekend much as it has the past two years: in political limbo after inconclusive elections, and with Prime Minister Benjamin Netanyahu's future on the line.

A final tally from an election on Tuesday showed Netanyahu's right-wing Likud and kindred factions short of a majority in parliament.
But his rivals also came up short.

According to the final results published by Israel's Central Elections Committee, a Netanyahu-led coalition would control 52 seats in the 120-member parliament. An opposition grouping would control 57 seats.

Both Netanyahu and those seeking to topple him were deep in complex coalition arithmetic on Friday as Israelis - politically exhausted after four elections in two years - prepared for the March 27-April 3 Passover festival.

Netanyahu's opponents called for him to step aside and allow a new era to begin.

"For the fourth time in two years, Netanyahu has failed and not succeeded in achieving a parliamentary majority of 61," Gideon Saar, a Likud defector, wrote on Twitter.

"I call on Netanyahu: move aside, free Israel and allow the country to move forward."

Saar leads the New Hope party, which won six seats and is looking to persuade Likud supporters that while Netanyahu was their passport to power since 2009, he may now have become an obstacle to them.

Yair Lapid, another Netanyahu opponent whose center-left party Yesh Atid won 17 seats, retweeted Saar's call with the message "Listen to Gideon."

By contrast, Netanyahu on Twitter confined himself on Friday to saying that more than a million Israelis had voted for Likud, making it the "largest party in Israel." He wished Israelis a Happy Passover amid a relaxation of coronavirus restrictions that allowed families to gather at the holiday table.

As they shopped ahead of the Passover holiday's commencement at sunset on Saturday, some Israelis said they were weary of elections.

"Passover is supposed to represent our exodus from Egypt, right? So what will it take to get an exodus from this political crisis?," said Ran Peretz, 46, in Tel Aviv.

Others couldn't resist referencing more recent events in Egypt.

"Netanyahu is the political equivalent of the ship blocking the Suez Canal," was the headline of an article in the Haaretz newspaper by commentator Amos Harel.

WHAT NEXT?

Netanyahu's political fate may depend on the leaders of two wild-card parties.

Although poles apart politically, far-right Naftali Bennett's Yamina party won seven seats, and [https://www.cruisewhat.com/is-nutritional-yeast-kosher-for-passover/ www.cruisewhat.com] Mansour Abbas's Arab Islamist faction won four seats - and under Israel's coalition system both are potential kingmakers wielding influence disproportionate to their number of seats.

But, complicating the negotiations, some of Netanyahu's natural right-wing allies have said they will not support him if he partners with Abbas' United Arab List, which has pro-Palestinian sympathies.

And Netanyahu finds himself for the first time in the recent run of elections without his close U.S.

ally President Donald Trump, who made a series of policy changes that aligned closely with Netanyahu.

In an apparent easing of the Trump-era approach, the Biden administration announced on Thursday that it will give the Palestinians $15 million to aid their COVID-19 response.

Palestinian Prime Minister Mohammad Shtayyeh welcomed the move as "an important step in the right direction to reshape the relationship with the U.S. administration." (Reporting by Rami Ayyub in Tel Aviv and Stephen Farrell in Jerusalem Additional reporting by Ali Sawafta in Ramallah Editing by Giles Elgood)

adverts.addToArray({"pos":"inread_player"})Advertisement
