A Jewish lawyer was awarded a payout of over £26,000 in a religious discrimination case after he was sacked for not coming into work during Passover.<br>Philip Bialick, 43, is forbidden by his religion from working during the first two days of the Jewish holiday, and had booked the time off from his job at NNE Law in Manchester.<br>The firm is run by Ali Nazokkar, who was a friend of Mr Bialick and had employed him in January 2020 as a litigation executive.<br>But shortly after the pandemic hit, relations started to go downhill.<br><br>An employment tribunal heard that Mr Bialick, who lives in Bury, was unable to come into the office for the two weeks leading up to Passover, after developing symptoms of .<br>        Philip Bialick, 43, is forbidden by his religion from working during the first two days of the Jewish holiday<br>He received a letter from his boss as his holiday was due to start, informing him he'd be fired if he didn't return to work the next day - as company policy didn't allow him to have more than two weeks off.<br><br>Despite responding to Mr Nazokkar via email during the first day of Passover begging to keep his job, Mr Bialick was fired from his position with immediate effect.<br>He has since been awarded compensation following a tribunal at Alexandra House in Manchester which concluded in December 2021.<br>It ruled he'd been discriminated on the grounds of his religion.<br>But Mr Bialick says he still hasn't received a penny of the £26,000 awarded by the court, and has had to instruct bailiffs to try and collect the money he is owed by the business.<br><br>NNE Law claim they have not paid out 'due to an application having been made for a stay of execution of the order as there are grounds for appeal which are currently being pursued'.<br>But Mr Bialick, speaking to the M.E.N., said: 'The owners are two brothers and were friends of mine for 12 years.<br>It's even more upsetting because they were friends.<br>'I've still not received the money. It was a ghost town, it was very scary.<br>'I got ill with coronavirus symptoms and I got signed off by the NHS and given an isolation note. That ended just before the Jewish holiday which I had booked off.'<br>The tribunal heard Mr Bialick's leave for Passover had been granted from April 8 to 17.<br><br>The first two days are classed as 'High Holidays', meaning a Jewish person is not allowed to work, drive, or undertake activities of any sort.<br>But shortly before Passover was due to start, Mr Bialick received a letter from Mr Nazokkar stating if he did not return to work on April 9 he would be dismissed.<br>The firm stated they'd cancelled his holiday due to company policy which said that an employee couldn't be off for more than two weeks at a time - something Mr Bialick said he was never aware of.<br>        Mr Nazokkar was ordered to pay a total of £26,479.86 to Mr Bialick<br>'I'd booked the Jewish holiday off near enough when I started.<br><br>It was agreed and the younger brother sat next to me and we spoke all the time,' he said.<br>'The day I received the letter was the first day of Passover. I had to break Jewish law by emailing them but I did it because I knew there was a lot at stake.<br>'I was absolutely gobsmacked when they told me I would have to come in on a Jewish holiday.<br>They were Muslim and we embraced our differences.'<br>Mr Bialick said following his dismissal his mental health deteriorated and he spiralled into debt. He has since been hired by a new law firm who are providing him with support.<br>'It was really bad.<br><br>I had no money at all. I went pretty much off the rails.. My mental health deteriorated massively. I didn't know where to turn,' he said.<br>'I was really upset and angry about how they treated me. I was desperate at the time as there was no work so I applied for an employment tribunal straight away.'<br>Following a three-day trial, a judge ruled Mr Bialick had succeeded in his complaint of indirect discrimination based on his religion or belief, under the Equality Act.<br><br>Mr Nazokkar was ordered to pay a total of £26,479.86 to Mr Bialick within 14 days of the hearing's conclusion - which was now over four months ago.<br>'Since then I've been chasing them and instructed bailiffs,' Mr Bialick said.<br>'I have lost a lot of money.<br>I'm getting to the point now where I'm desperate. I'm waiting for this money to come through and if it doesn't I'm in trouble.'<br>A spokesperson for NNE Law said: 'I would like to advise that the reason the judgement has not yet been satisfied is due to an application having been made for a stay of execution of the order as there are grounds for appeal which are currently being pursued.<br>'As this is a live matter, I am unable to go into detail about this.<br><br>NNE Law prides itself on it's diverse staff and having an inclusive approach.
